Resolution Regarding Property Abandoned, Obsolete, Undesirable or Unsuitable for School Purposes of the District:

The trustees of the Malta School District have determined that the following property of the district, located at the Head Start Building is abandoned, obsolete, undesirable, or unsuitable for school purposes of the Malta School District.

The subject property is abandoned, obsolete, undesirable, or unsuitable for school purposes because it has been in storage for up to Five (5) years, including but not limited to various tools, computer equipment, office equipment and office furniture. Sealed bids will be taken on a 1988 Ford ½ ton and a 2010 Mercury Grand Marquis LS (Minimum bid $5000).

As provided in § 20-6-604, MCA, the trustees of the Malta School District hereby resolve to sell off the property identified above because it is or is about to become abandoned, obsolete, undesirable, or unsuitable for school purposes of the Malta School District.

The trustees of the Malta School District further resolve that notices of the resolution shall be published on the 18th and 25th days of July 2018, in the Phillips County News newspaper.

This resolution shall become effective 14 days after publication of the second notice identified in the immediately preceding paragraph, unless appealed to the district court by a taxpayer in compliance with and as provided in §20-6-604, MCA.

The Malta Public Schools will hold a garage sale August 9, 2018, at the Malta Head Start Building from 9:00 a.m. until 12:00 p.m.

SHOW-CAUSE HEARING

RESPONDENT: SCOUT ENERGY MANAGEMENT LLC – FALLON, PHILLIPS, RICHLAND, ROOSEVELT, AND VALLEY COUNTIES, MONTANA

Upon the Board’s own motion to require Scout Energy Management LLC to appear and show cause, if any it has, why additional penalties should not be imposed for failure to file production reports and to pay the administrative penalty assessed for delinquent reporting. In accordance with Board policy the amount due now is $8,280. This docket will be dismissed if payment and reports are received prior to the hearing. Failure to appear at the Show Cause hearing or to make suitable arrangements prior to said hearing subjects Scout Energy Management LLC to further penalties as prescribed by Board Policy.

NOTICE OF TRUSTEE'S SALE

On Monday, October 29, 2018, at the hour of 10:00 a.m., Mountain Daylight Savings Time of said day, at the front door of the Phillips County Courthouse, Malta, Montana, Dan O'Brien, Attorney at Law, as Trustee, will sell at public auction to the highest bidder for cash in lawful money of the United States payable at the time of sale, the real property, situate in Phillips County, State of Montana, more particularly described as follows:

Tract B of Certificate of Survey #219, located in Government Lot 8 of Section 8, Township 30 North, Range 30 East, M.P.M.

EXCLUDING therefrom Parcel No. 12 on Montana State Highway Project STPS 242-1(8)0, as shown on the Right-of-Way plan for said project on file in the office of the County Clerk and Recorder, Phillips County, Montana

Said sale will be made without covenant of warranty regarding title, possession or encumbrances to satisfy the obligation secured and pursuant to the power of sale conferred in a Montana Trust Indenture dated November 12, 2009, recorded on November 17, 2009, in Book 41 of Documents, page 474-488, Instrument No. 340456, of the records of Phillips County, Montana, wherein ROBERT GLEN SHIPPEN is the Grantor; FIRST SECURITY BANK is the Beneficiary; and PHILLIPS COUNTY TITLE COMPANY is the Trustee, to secure the payment of $105,550.14 with interest, and any other amounts and/or obligations secured thereby. The defaults for which this sale is to be made are the following: the failure of ROBERT GLEN SHIPPEN to pay installments due under the note secured by said Trust Indenture. There is presently due on the obligation the principal sum of $97,769.43 plus accrued interest of $4,763.58 as of March 19, 2018, together with accruing interest thereon at the rate of $22.09 per day. Other expenses to be charged against the proceeds include the Trustee's and attorney's fees, delinquent taxes and insurance, and costs and expenses of sale.

The Trustee and Beneficiary have elected to sell the property to satisfy the obligation.

At a regular meeting of the Board of County Commissioners, a petition signed by several residents and taxpayers of PHILLIPS COUNTY was presented to the Board requesting

An AUTO GATE will be placed at the following location:

Township 29 North, Range 26 East P.M.M.

Located in SESE section 13 on south common boundry line with section 24

Located off Stage Rd

A by-pass gate must be provided for trailing cattle or moving machinery when necessary.

A hearing will be held on said petition on Tuesday July 30, 2018 at 2:00 p.m. in the Commissioners' Room at the Phillips County Courthouse, at which time anyone may appear either for or against the said petition.
