NOTICE OF PUBLIC HEARING TO EXTEND THE INTERIM ZONING ORDINANCE PROHIBITING THE OPENING OF ANY NEW ESTABLISHMENTS THAT GROW, SELL OR DISTRIBUTE MEDICAL MARIJUANA FOR AN ADDITIONAL TWELVE (12) MONTH PERIOD, AND PROHIBITING THE OPERATION OF MEDICAL MARIJUANA STOREFRONTS PURSUANT TO THE MONTANA MARIJUANA ACT.

The Phillips County Commissioners are calling for a Public Hearing to receive public input on whether or not to extend the zoning ordinance adopted August 21, 2017, which prohibits the growth, sale, and distribution, of medical marijuana, and any establishment attempting to grow, sell, or distribute medical marijuana or paraphernalia in Phillips County, outside the incorporated boundaries of the City of Malta, Town of Saco, or Town of Dodson.

The Phillips County Commission has determined after its required investigation that the licensing, opening, or operation of any establishments that grow, sell, or distribute medical marijuana or paraphernalia within Phillips County could be immediately detrimental to, harmful to, and a threat to the peace, property, health, safety, and welfare of the County and its inhabitants, and can, through such an effect, create a public nuisance and have adopted a resolution to extend the interim zoning ordinance for a period of one year to regulate medical marijuana growth, sale, and distribution, and any establishment attempting to grow, sell, or distribute medical marijuana or paraphernalia in Phillips County, outside the incorporated boundaries of the City of Malta, Town of Saco, or Town of Dodson

Until such new ordinances, zoning or otherwise, are adopted and in place to regulate medical marijuana growth, sale, and distribution, any establishment attempting to grow, sell, or distribute medical marijuana or paraphernalia in Phillips County, outside the incorporated boundaries of the City of Malta, Town of Saco, or Town of Dodson, shall be prohibited. This Resolution specifically prohibits any new or lawfully existing medical marijuana provider or marijuana-infused products provider from establishing a new dispensary or grow operation, or expanding the number of plants currently growing on the property. This prohibition shall not apply to a registered cardholder who possesses not more than four mature marijuana plants, twelve seedlings and one ounce of usable marijuana as provided by the Act, nor shall it apply to a provider, already registered with the Phillips County Sanitarian and in operation at their designated location on the date of this Ordinance, who possesses not more than four mature marijuana plants, twelve seedlings and one ounce of usable marijuana solely for each of his or her registered cardholder’s use or as provided the Montana Marijuana Act.

The interim ordinance is on file for public inspection at the office of the Phillips County Clerk and Recorder.

The public hearing will be held in the office of the Phillips County Commissioners, Phillips County Courthouse, 314 South 2nd Avenue West, Malta, MT at 1:30 p.m. on August 13, 2018. At such hearing members of the public will be encouraged to offer comment on the proposed Ordinance and any persons not able to attend the hearing may submit written comments prior to the hearing, by sending or deliver such comments to the Board of County Commissioners, Box 360, Malta, MT 59538.

RESOLUTION REGARDING PROPOERTY ABANDONED, OBSOLETE,

UNDESIRABLE OR UNSUITABLE FOR SCHOOL PURPOSES OF THE DISTRICT

The Trustees of School District No. 12 A & B have determined that the following real and personal property of the district, located at 321 Hwy 243, Saco, Montana, is obsolete, unsuitable or not needed any longer for school purposes of School District No. 12 A & B.

The subject property is abandoned, obsolete, undesirable, or unsuitable for school purposes because it has been in storage for up to Five (5) years, including but not limited to various tools, science equipment, computer equipment, industrial refrigerator, office equipment and office furniture.

The subject property is obsolete, unsuitable or not needed any longer for school purposes.

As provided in § 20-6-604, MCA, the Trustees of School District No. 12 A & B hereby resolve to sell or dispose of the property identified above.

The Trustees of School District No 12 A & B further resolve that notices of the resolution shall be published on July 25, 2018 and August 1, 2018, in the Phillips County News newspaper.

This resolution shall become effective 14 days after publication of the second notice identified in the immediately preceding paragraph, unless appealed to the district court by a taxpayer in compliance with and as provided in § 20-6-604, MCA.

Bids will be publicly opened, read aloud, and accepted for consideration at the August regular board meeting, scheduled for 7:00 PM August 8, 2018 at the Malta Middle/High School Teacher workroom located in Malta, MT. Your offer will be required to be submitted under a condition of irrevocability for a period of 30 days after submission.
