NOTICE OF LAND SALE

Larry Ochsner, Leann Ochsner, and Robert D. Ochsner will sell to the highest bidder, for cash, the following real property located in Phillips County Montana which is described as follows:

TERMS AND CONDITIONS OF SALE:

Sealed bids will be received on the real property at any time prior to 11:00 a.m. on November 18, 2019. Bids must be in a sealed envelope, must state if they are for Parcel 1, Parcel 2, or the entire property and must be submitted to the Law Office of Cole, Amestoy & O’Brien, PLLP, P.O. Box 1280, 113 South 2nd Street W., Malta, Montana 59538 prior to the above time.

Ten percent (10%) of the amount of the bid in the form of certified funds must be delivered to the Closing Agent within five (5) days of the bid acceptance. The successful bidder shall pay the balance of the purchase price on the date of Closing, which shall occur for Parcel 1 on December 20, 2019 and Parcel 2 on January 7, 2020.

Seller states that all farm land is organic farming a portion of the property is subject to Lease which will expire December 31, 2022. A copy of the lease will be available to interested bidders. Also, one property is in CRP until the fall of 2020.

Real property taxes for 2019 shall be paid by Seller.

Seller and Purchaser shall each pay one-half of the Closing Agents’ fees and costs.

Seller will accept bids for Parcel 1, Parcel 2, and for the whole property. Seller reserves the right to sell the property in parcels or as a whole.

Seller will provide a standard owners title insurance policy and a preliminary commitment of title will be available for review by interested bidders.

Seller shall retain any and all mineral rights existing on the property.

Seller shall retain 25% of wind and solar power development and royalty rights on the property.

Sealed bids will be opened at 1:00 p.m. on November 18, 2019.

Seller reserves the right to reject any or all bids.

PUBLIC NOTICE

In accordance with § 75 10 735(4), Montana Code Annotated (MCA), the Montana Department of Environmental Quality (DEQ) hereby gives notice of approval of the Voluntary Cleanup Plan (VCP), including Addendum #2, for the Malta Airport Facility in Malta, Montana. DEQ solicited public comment on this document for 30 days, September 18, 2019, through October 17, 2019. DEQ did not receive any comments during this time period. DEQ has concluded that the VCP meets the requirements specified in § 75-10-734, MCA, and, if implemented as approved, will attain a degree of cleanup and control of hazardous or deleterious substances that complies with the requirements of § 75-10-721, MCA. DEQ previously approved the City of Malta’s VCP for excavation and off-site disposal of soil within the Facility that exceed site-specific cleanup levels (SSCLs) based on future commercial/industrial use within the area proposed for future commercial/industrial use in the VCP and the City’s proposal for restrictive covenants in these areas to prohibit future residential development. In the area currently used as residential property, the City proposed to clean up to SSCLs protective of residential use with no future property use restrictions. This VCP-RP Addendum #2 re-evaluates the risk to recreational campers utilizing the property for a restricted amount of time per year, recalculates the associated previously-approved SSCLs, and revises the previously-approved restrictive covenants to allow camping on the City’s property up to 80 days per year. The previously approved 2016 VCP-RP Addendum allowed for 100 days of camping per year. The VCP is available for review at the Phillips County Library in Malta, and the DEQ’s office located at 1225 Cedar Street in Helena. NOTICE OF TAXES DUE

2019 Real Property taxes have been mailed and notice is hereby given that the first half of all taxes levied and assessed will be due and payable before 5 p.m. on Monday, December 2, 2019 and that unless paid prior to that time the amount then due will be delinquent and will draw interest at the rate of 5/6 of 1% per month from the time of delinquency until paid and 2% will be added to the delinquent taxes as a penalty.

And that the second half of all taxes levied and assessed will be due and payable on or before 5:00 p.m. on June 1, 2020, and that unless paid prior to that time the taxes will be delinquent until paid, and 2% will be added to the delinquent taxes as a penalty.

NOTICE OF SEWER RATE INCREASE

AND PUBLIC HEARING

NOTICE IS HEREBY GIVEN that on October 8, 2019, the City Council (the “Council”) of the City of Malta, Montana (the “City”), adopted a Resolution of Intention of the City of Malta, Montana to Increase Rates and Charges for the Use and Availability of the Municipal Sewer System (the “Resolution”).

The City has determined it is necessary to undertake certain improvements to the City’s municipal sewer system (the “System”) on an emergency basis, and anticipates issuing sewer system revenue bonds to pay the costs of such improvements. It is necessary for the City to increase its sewer rates to to pay the costs associated with the operation and maintenance of the System, pay debt service on its outstanding bonds and the bonds proposed to be issued, and to establish appropriate reserves.

The City currently charges users of the System a monthly rate of $33.00 per unit, with each type of service assigned a particular number of units, as set forth below:

Commencing with the December 2019 billing, the City proposes to charge customers connected to the System a monthly charge (the “Proposed Monthly Charge”) of $37.50 per unit, based on the units set forth above.

In addition, the City currently charges unoccupied units $5 per month. Commencing with the December 2019 billing, the City proposes to charge unoccupied units the full Proposed Monthly Charge for such unit.

For occupied units, the Proposed Monthly Charge represents an increase of approximately 13.6% over the current monthly charge. For unoccupied units comprising one unit, the Proposed Monthly Charge represents an increase of approximately 650% over the current monthly charge.

A public hearing on the proposed rate increase will be held on November 12, 2019, commencing at 5:00 p.m., at Malta City Hall, 39 South 2nd Street East, in Malta, Montana.
