PUBLIC HEARING

The Phillips Conservation District will hold a public hearing on Tuesday, July 11, 2017 at 1:00 p.m. at the USDA Conference Room, 1120 Hwy 191 S., Malta, Montana. The purpose of the public hearing will be to review the conservation district final budget and to consider levying a permissive medical mill to cover the increased costs in the group’s benefits line item for FY 2018. The Mortgage was recorded in the Phillips County Courthouse on April 28, 1982 and in the Blaine County Courthouse on May 24, 1982. The Mortgage was also recorded in the Bureau of Indian Affairs Land Titles and Records Office in Billings, Montana (see 25 CFR 150). A review of the land records at all three locations revealed that a partial release of the Mortgage on two of the trust tracts (467-A and 900-B) was executed by the First National Bank of Browning, Montana on August 3, 1982. A search of the land records at all three locations in April of 2017 did not disclose any additional releases, satisfactions or foreclosures of this Mortgage. On October 11, 1983, the First National Bank of Browning, Montana failed and no active institution received any of its deposits or assets. On November 11, 1983, the First National Bank of Browning was closed by the Federal Deposit Insurance Corporation (FDIC) and the FDIC was subsequently appointed as Receiver. On June 25, 1990, the United States District Court for the District of Montana Great Falls Division issued an Order approving a Petition For The Termination of the FDIC Receivership in the Matter of Liquidation of the First National Bank of Browning. The Order declared that all assets and liabilities of the First National Bank of Browning have been fully liquidated and that all claims of depositors and creditors of the bank have been fully administered. In addition, the Order directed, among other things, that all stationary, correspondence, books and records kept by the Bank be destroyed; terminated the FDIC Receivership; and discharged FDIC from any further liability and responsibility in connection with the assets and affairs of the failed Bank. The purpose of this NOTICE is to provide any valid interested party, including FDIC, an opportunity to oppose or object to a finding that this Mortgage no longer exists as an encumbrance on this trust land. In addition, the land records in the Land Titles and Records Office of the Bureau of Indian Affairs should reflect the Mortgage is not encumbering this individually-owned trust land. This legal notice will provide the necessary documentation allowing the LTRO to issue a Certified Title Status Report depicting the trust title on these individually-owned lands as being free from a Mortgage encumbrance. Absent any written objection from any valid interested party within sixty (60) days from the date this NOTICE is FIRST published in the appropriate newspapers, this Mortgage will no longer be reflected as encumbering this trust land.
