Miramon Jr. In Court, Changes Plea to Guilty

Ernest Miramon Jr. appeared in court at 2 p.m. on Monday, September 20, to accept a plea agreement, and change his plea from not guilty to guilty.

Judge Yvonne Laird, in Blaine County, called the courtroom to order. Both the prosecution lawyers, with the primary attorney being Dan O'Brien, and the defendant, along with his attorney, Paul Neal, were present via video from Glasgow.

Judge Laird asked the defendant if he understood his rights to a trial, and that by taking the plea agreement, he will forfeit those rights.

The Judge asked the defendant several times if he is happy with the council he has and if he feels his council has explained everything thoroughly to him.

Judge Laird asked the defendant many times if he understood all of the terms of the plea agreement.

All of the answers were "yes".

The judge then asked the defendant to rise, then asked Miramon Jr. how he pled on each of the two counts of Sexual Assault Felony where the victim is Less than 16 and the Offender is at least Three Years Older. Both happening in Phillips County between the years of 2006-2013.

The answer on both counts: "Guilty"

The plea agreement that was signed is for 40 years with 20 of those years suspended. Judge Laird will have the final say as to what the defendants' sentence will be. Each felony count can carry a maximum of life in prison to no less than four years.

The next step in this case, is for a sexual psychological evaluation to be done by a doctor that both sides have agreed on.

The sentencing hearing has been set for Monday, December 13, 2021, at 10 a.m. At that time, the plaintiffs of this case can make their statements.
