NOTICE OF PUBLIC HEARING ON PROPOSED FY23 BUDGET AMENDMENT

NOTICE IS HEREBY GIVEN that the Board of County Commissioners of Phillips County, Montana intend to amend the budget for the 2023 fiscal year and that said budget amendment affects the following functions: local assistance and tribal consistency fund, local option motor vehicle tax fund, CDBG grant fund, general election, state gas tax FLAP.

The purposed amendment will be due to the unanticipated revenue received from the State and Federal government due to the COVID-19 pandemic and other grants. Details are open to public inspection in the office of the County Clerk, 314 S 2nd Ave W, Malta, Montana.

The Board will meet on the 22nd day of May, 2023 at 2:00 p.m. for the purpose of holding a public hearing and consideration of the amendment to the original budget. Said hearing is to be held in the Commissioners’ Office in the Phillips County Courthouse, 314 S 2nd Ave W, Malta Montana.

Any taxpaper or resident may appear at the hearing and will be heard for or against any part of the proposed budget amendments.

The City of Malta will conduct a Public Hearing May 9, 2023 at 5:00 p.m. in the Council Chambers of City Hall. The purpose of the public hearing is to receive public comments concerning Resolution 1328 – A Resolution Adopting a Capital Improvements Plan for the City of Malta. The final draft of the City of Malta Capital Improvements Plan can be viewed on the City of Malta website or at the City Clerk’s Office. Phillips County PO Box 360, Malta MT 59538, 406-654-2423, will apply to the DEQ Opencut Mining Section for a 15.1-acre permit to mine gravel at the Kornfeld Site in Section 20, T33N, R29E, Phillips County. Operator will strip soil material for reclamation use; excavate, process, and haul gravel; and reclaim disturbed area to grassland. Site will be reclaimed and ready for release no later than 12/2047. NOTICE OF TRUSTEE’S SALE

The undersigned hereby gives notice that on the 30th day of August, 2023, at the hour of 11:00 o’clock A.M., at the front main entrance of the Phillips County Courthouse located at 314 South 2nd Avenue West in Malta, Montana, STEPHEN R. BROWN, JR., as the Successor Trustee of the Deed of Trust described below, under the direction of INDEPENDENCE BANK, in order to satisfy the obligation owed to it as set forth in this Notice, will sell at public auction to the highest bidder, for cash, lawful money of the United States of America, payable at the time of sale to the Successor Trustee, without warranty or covenant, express or implied, as to title or possession, the following described real property:

Lot 10 in Section Two Replat of Hill Crest Addition to Malta, Phillips County, Montana, according to the official recorded plat thereof.

Melody A. Esaias and Kasey J. Esaias, as Grantor, conveyed the above-described property to Phillips County Title Company, as Trustee, to secure an obligation owed Independence Bank, as Beneficiary; which said obligation is secured by a Deed of Trust dated May 24, 2016, and recorded May 24, 2016, in Book 68 of Documents, pages 975-985, as Instrument No. 349851, records of Phillips County, Montana. The Beneficiary subsequently appointed Stephen R. Brown, Jr., attorney at law, as the Successor Trustee for said Deed of Trust by instrument recorded April 7, 2023, in Book 103 of Documents, page 265, as Instrument No. 361292, records of Phillips County, Montana.

The default in the obligation, the performance of which is secured by the above-referenced Deed of Trust, and for which default this foreclosure is made, is the failure by the Grantor or the Grantor’s successor-in-interest, to timely pay the monthly installments of principal and interest under the terms of the Promissory Note for which the above-described Deed of Trust was given as security.

As of March 29, 2023, the following amounts were owed on the obligation secured by the Deed of Trust:

Unpaid principal balance: $114,916.19

Accrued interest balance: $2,407.25

Daily interest accrual from and after

March 29, 2023: $17.3476

Late charge balance: $857.52

Fee balance: $75.00

The Beneficiary has elected to sell the above-described real property to satisfy the aforementioned obligation, and has instructed the Successor Trustee to do so. The sale is a public sale and any person, including the Beneficiary, and excepting only the Successor Trustee, may bid at the sale. The bid price must be paid in cash. The conveyance will be made by Trustee’s Deed, made “AS IS”, without representation or warranties, express or implied, including warranties of title, possession or encumbrances. The purchaser shall be entitled to possession of the property on the tenth day following the date of sale.

The sale may be postponed up to 15 days for any reason by public proclamation at the scheduled sale. If there is a stay by bankruptcy or court order, the sale may be postponed up to 30 days at a time by public proclamation, for a total of no more than 120 days.

The Grantor or successor-in-interest to the Grantor, or any other person having an interest in the property, at any time prior to the sale date, may pay to the Beneficiary the total amount then due under the Deed of Trust, including foreclosure costs and expenses incurred, and trustee and attorney’s fees due to date of payment.

The Phillips County Planning Board will hold a Public Meeting and Public Hearing for the review of the update to the Phillips County Growth Policy. A draft of the updated Phillips County Growth Policy will be available to the public for review at the Phillips County Clerk and Recorder’s office.

The Public Meeting and Hearing will be held on Tuesday the 16th day of May 2023, at the Phillips County Court House downstairs conference room in Malta, MT at 5:15 P.M., at which time all interested persons will be given the opportunity to comment.

CALL FOR BIDS

CONGREGATE AND HOME DELIVERED MEALS

Phillips County, hereby invites for bid, congregate and home delivered meals for the elderly for July 1, 2023 to June 30, 2024. The County Commissioners have determined the minimum cost to provide this service under this contract must be at least $5.00 per plate. Meals served must be acceptable to the elderly consumer and meet one-third of the RDA and provide a minimum of 600 calories. Meals will be served on days and at a time mutually agreed upon by the two parties, using the following meal pattern:

meat or alternate—three edible ounces

vegetables and fruit – 3 servings

vegetable serving – 1 cup leafy greens or ½ cup cooked

fruit serving – ½ cup or 1 serving

grains – 2 servings (whole grains: 100% whole wheat breads, pastas, brown rice)

dessert--one-serving

milk or dairy equivalent – 1 serving

coffee or hot tea

The caterer is responsible for following all safety and sanitation regulations as established by the State of Montana under the 2013 Model Food Code for retail establishments, including the 2015 rule update. Caterers must be inspected by the County Sanitarian and the Caterer must have the appropriate business license. The caterer is responsible for paying all costs of food, supplies, labor and other costs as necessary in providing the meals. Meals may be served on site or catered to another location. The location of meals served on site should be accessible to the people with disabilities. The bid for the Home Delivered Meals to Malta residents will be included in the Congregate Meal bid at $1.00 more per meal. Home delivered meals are to include using Styrofoam containers provided by caterer. Bids must be received in the Clerk and Recorder’s office, Phillips County Courthouse, P.O. Box 360, Malta, MT by 5:00 p.m. on Friday, May 12, 2023. Bids will be opened at 2:00 p.m. on Monday, May 15, 2023. Special consideration for the home delivered meal bid will be given for the services of a dietitian. Phillips County reserves the right to reject any and all bids, to waive irregularities, or to accept any bid they deem to be in the best interest of Phillips County.

PHILLIPS COUNTY HEREBY ALSO INVITES FOR BID,

meals delivered to the jail for July 1, 2023 to June 30, 2024. The County Commissioners have determined the minimum cost to provide this service under this contract must be at least $5.00 per plate. Meals will be served at a time mutually agreed upon by the two parties, using the above meal pattern. The noon meals are to be delivered to the jail. The evening meals will be picked up. The bid for the jail meals is to include using Styrofoam containers provided by caterer. Bids must meet above specifications as to safety and sanitation as well as to caterer responsibilities. Bids must be received in the Clerk and Recorder’s office, Phillips County Courthouse, P.O. Box 360 Malta, MT by 5:00 p.m. on Friday, May 12, 2023. Bids will be opened at 2:00 p.m. on Monday, May 15, 2023. Phillips County reserves the right to reject any and all bids, to waive irregularities, or to accept any bid they deem to be in the best interest of Phillips County.
