MONTANA SEVENTEENTH JUDICIAL DISTRICT COURT, PHILLIPS COUNTY

In Re the Matter of the ) No. DV-2024-03

Name Change of: )

ROBERT JAMES CAVES: ) ORDER DENYING REQUEST TO PROCEED ON A SEALED-RECORD BASIS AND SETTING HEARING

ON PETITION FOR NAME CHANGE FOLLOWING PUBLICATION

(Your Name now) )

)

Robert James Caves )

Petitioner (your name now) )

On March 1, 2024, this Court issued Order for Additional Information and to Temporarily Seal file. On March 13, 2024, Petitioner, Robert James Caves filed an Affidavit with Addendums attached thereto. Previously, Petitioner filed a Petition for Name Change (Safety at Risk). Within the Petition, Petitioner requested that the matter proceed as a sealed-record basis without publication as allowed by 27-31-201(3), MCA.

After having reviewed Petitioner's Affidavit and Addendums, the Court finds the Petitioner has failed to show probable cause that the safety of the Petitioner is at risk. The documentation provided the Court is vague and lacking in any details demonstrating an actual risk to the Petitioner.

THEREFORE, IT IS HEREBY ORDERED that:

Petitioner's request to proceed as a sealed-record basis is DENIED.

This matter shall be unsealed.

A hearing on the Petition for Name Change shall be held on Monday, May 13, 2024, at 10:00 A.M. at the courtroom of the Phillips County Courthouse in Malta, Montana.

The notice of hearing shall be published in the Phillips County News for four (4) consecutive weeks prior to the hearing. Failure to publish notice will result in the dismissal of this matter.

The Clerk shall send a copy of this Order to Petitioner.

DATED this 15th day of March, 2024.
