Proclamation

Budget Amendment Resolution

Malta Public School District 14A, Phillips County, Malta, Montana

At a Regular School Board meeting Wednesday, September 9, 2015,

the following resolution was introduced:

WHEREAS, the Trustees of the Malta School District 14A have made a determination that as a result of unforeseen needs of the district that cannot be postponed without affecting the safety of students and employees or the education functions of the district, the district’s budget for the general fund does not provide sufficient financing to properly maintain and support the district’s needs for the entire current year; and

WHEREAS, the trustees have determined that an amendment to the general fund budget in the amount of $45,000.00 is necessary under the provisions of Section

20-9-161, subsection 6, MCA; for the purpose of hiring additional staff; and

WHEREAS, the anticipated source of financing the budget amendment

expenditures shall be the prior year excess reserves;

THEREFORE BE IT RESOLVED that the Board of Trustees of School District 14A, Phillips County, Montana, proclaims a need for an amendment to the general fund budget for fiscal year 2016 in the amount of $45,000.00 under Section

20-9-161, subsection 6, MCA for the purpose identified above, and;

BE IT FURTHER RESOLVED that the Board of Trustees of the School District 14A, Phillips County, Montana, will meet at the Regular School Board Meeting, October 7, 2015 at 7:00 p.m. for the purpose of considering and adopting the

budget amendment. This meeting is open to the public and any taxpayer in the district has the right to appear and be heard.

Resolution Regarding Property Abandoned, Obsolete, Undesirable or Unsuitable for School Purposes of the District:

The trustees of the Malta School District have determined that the following property of the district, located at the Head Start Building is abandoned, obsolete, undesirable, or unsuitable for school purposes of the Malta School District.

The subject property is abandoned, obsolete, undesirable, or unsuitable for school purposes because it has been in storage for up to Five (5) years, including but not limited to various tools, computer equipment, office equipment and office furniture.

As provided in § 20-6-604, MCA, the trustees of the Malta School District hereby resolve to sell off the property identified above because it is or is about to become abandoned, obsolete, undesirable, or unsuitable for school purposes of the Malta School District.

The trustees of the Malta School District further resolve that notices of the resolution shall be published on the 16th and 23rd days of September, 2015, in the Phillips County News newspaper.

This resolution shall become effective 14 days after publication of the second notice identified in the immediately preceding paragraph, unless appealed to the district court by a taxpayer in compliance with and as provided in §20-6-604, MCA.

The Malta Public Schools will hold a garage sale October 28, 2015, at the Malta Head Start Building from 9:00 a.m. until 3:00 p.m.

The instrument under which this sale is to be conducted is that certain Trust Indenture dated September 8, 2006, which Abstract for such Trust Indenture was recorded September 8, 2006, under Reception No. BK 27, PG 132-133 (335084), records of the Clerk and Recorder of Phillips County, Montana (the “Trust Indenture”).

DEFAULT FOR WHICH FORECLOSURE IS MADE:

The nonpayment of the amounts due pursuant to the Note and Trust Indenture both dated September 8, 2006, referred to above (and all their extensions, renewals, modifications or substitutions).

SUM OWING ON OBLIGATION SECURED BY THE TRUST INDENTURE:

There is presently due on the obligation secured by the Trust Indenture the principal sum of Eighteen Thousand Two Hundred Thirteen and 97/100 ($18,213.97), together with interest thereon, which as of July 21, 2015 totaled Three Thousand Seven Hundred Sixteen and 65/100 ($3,716.65), and Ten Dollars ($10.00) for a service fee for a total amount due and owing as of July 21, 2015 of $21,940.62. Interest continues to accrue at the daily rate of $1.996.

In addition, the Beneficiary intends to disburse such amounts as may be required to preserve and protect the Premises, and for real property taxes and assessments that may become due or delinquent, unless such amounts or taxes are paid by the Grantor or the Grantor’s successor(s) in interest. If such amounts are paid by the Beneficiary, the amounts, taxes or assessments will be added to the obligation secured by the Trust Indenture. Other expenses to be charged against the proceeds of the sale include the trustee’s and attorney’s fees, costs and expenses of sale and late charges, if any.

ELECTION TO SELL:

The Beneficiary has elected and directed the Trustee to sell the Premises to the highest qualified bidder to satisfy the

above-mentioned obligations.

DATE AND TIME OF SALE:

The sale will be held on December 18, 2015, at 11:30 o’clock a.m, Mountain Standard Time or Mountain Daylight Time, whichever is in effect.

PLACE OF SALE:

The sale will be held at the front entrance to the Phillips County District Court, 314 S. 2nd Ave. W, Malta, Montana 59538.

TERMS OF SALE:

This sale is a public sale and any person including the Beneficiary (excepting only the undersigned Trustee) may bid at the sale. The bid price must be paid immediately upon the close of bidding in cash or cash equivalents (valid money orders, certified checks, or cashier’s checks). The conveyance will be made by Trustee’s Deed without any representation or warranty, including warranty of title, express or implied, as the sale is made strictly on an as-is, where-is basis, without limitation, the sale is being made subject to all existing conditions, if any, of lead paint, mold, or other environmental or health hazards.

The sale purchaser shall be entitled to possession of the property on the 10th Day following the sale.

RIGHT TO CURE:

The Grantor, successor in interest to the Grantor or any other person having an interest in the aforesaid property, at any time prior to the Trustee’s sale, may pay to the Beneficiary or the successor in interest to the Beneficiary the entire amount then due under the Trust Indenture and the obligation secured thereby (including costs and expenses actually incurred and attorney’s fees) other than such portion of the principal as would not then be due had no default occurred and thereby cure the default.

The scheduled Trustees Sale may be postponed by public proclamation up to 15 days for any reason, and in the event of a bankruptcy filing, the sale may be postponed by the Trustee for up to 120 days by public proclamation at least every 30 days.
