Tabb, LLC d/b/a Malta Tire Center, Petitioner,

vs.

Summit Concrete, Inc., Respondent.

The Court having considered the Petition to Enforce Lien filed under §71-3-1203, MCA and good cause appearing,

IT IS ORDERED that:

1. A hearing on the Petition to Enforce Lien be held before this court on the 26th day of April, 2016 at 1:15 o’clock p.m. in the courtroom of the Phillips County Courthouse at Malta, Montana, and the Respondent shall then and there show cause,

if any there be, why the Court should not issue an order directing the vehicle be sold

at a sheriff sale to satisfy the lien.

2. Petitioner shall cause service of its Petition and this Order upon Respondent

in the manner set forth in the Montana Rules of Civil Procedure at least five

(5) days before hearing.

3. Parties are hereby informed that any lien hereunder is subject to provisions

of priority set for in §71-3-1202, MCA.

4. The Clerk shall forthwith send a copy of this order to Petitioner’s counsel of record.

WHEREAS, The Board of Trustees of Whitewater School, District # 20D, Phillips County, State of Montana, have received nominating petition declarations equal to the number of positions to be elected and there is no other reason for the Trustee election.

THEREFORE, the regular Trustee Election will not be held and the necessary thirty day Notice of Cancellation has been made.

BE IT RESOLVED, that Trustee candidate Matthew Simonson is hereby duly elected by acclamation for a three year term to the Board of Trustees of Whitewater School District # 20D

WHEREAS, the number of candidates for the positions on the Whitewater

School Board of Trustees, District 20D is equal to or less than the number

of positions to be elected.

Therefore, the Whitewater School Trustees’ Election is hereby cancelled.

The levy proposition is not necessary for 2016-2017.

Resolution #1516-04 RESOLUTION REGARDING PROPOERTY ABANDONED, OBSOLETE,

UNDESIRABLE OR UNSUITABLE FOR SCHOOL PURPOSES OF THE DISTRICT

The Trustees of School District No. 12 A & B have determined that the following real and personal property of the district, located at 321 Hwy 243, Saco, Montana, is obsolete, unsuitable or not needed any longer for school purposes of School District No. 12 A & B. 2012 Ic Corporation Bus (Bus #3), 52 passenger, air brakes, side storage compartments, 89,575 miles, excellent condition The subject property is obsolete, unsuitable or not needed any longer for school purposes. As provided in

§ 20-6-604, MCA, the Trustees of School District No. 12 A & B hereby resolve to sell or dispose of the property identified above. The Trustees of School District No 12 A & B further resolve that notices of the resolution shall be published on April 20, 2016 and April 27, 2016, in the Phillips County News newspaper. This resolution shall become effective 14 days after publication of the second notice identified in the immediately preceding paragraph, unless appealed to the district court by a taxpayer in compliance with and as provided in § 20-6-604, MCA. Adopted by the Board of Trustees of School District No. 12 A & B this 13th day of April, 2016. We are taking sealed bid until May 20, 2016 with a minimum bid of $36,000.

NOTICE OF ANNUAL ELECTION

Notice is hereby given by the undersigned Clerk of Saco School District

No. 12 A & B, Phillips County, State of Montana that the Annual School Election will be held on Tuesday, May 3, 2016, at the following polling place:

Saco School Gym Foyer, 321 Highway 243, Saco, Montana

Electors will consider the following issue at the election:

• One Trustee to be elected for a three (3) year term.

The polls will be open between the hours of 12:00 p.m. and 8:00 p.m. on the day of the election. A qualified registered elector who will be unable to go to the polls on the date of election may request an Application for Absentee Voter’s Ballot from the school district clerk / election administrator’s office located at:

If you miss this regular registration deadline (30 days prior to the election), you may still register for the election by showing up at the county election office up to and including on election day. Notice is hereby given that regular* registration for the Federal Primary Election

to be held on June 7, 2016 will close at 5:00 p.m., on Monday, May 9, 2016.
